CNXION provides its freelance marketplace platform on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding:
- The accuracy, reliability, or continuous availability of the platform
- The quality, timeliness, or outcome of services provided by service providers
- The accuracy of user profiles, qualifications, portfolios, or certifications
- The suitability of any service provider for your specific AI or blockchain project needs
- The success or outcome of any project or engagement facilitated through our platform
2. Platform Role
CNXION acts solely as a marketplace platform connecting Clients with Service Providers specializing in AI and blockchain expertise. We are not a party to any agreements, contracts, or transactions between users. We do not:
- Employ, endorse, or guarantee any service provider on our platform
- Control the quality, accuracy, or legality of work delivered by service providers
- Supervise, direct, or manage the performance of any project
- Guarantee the accuracy of user-provided information, including skills, experience, or credentials
- Act as an agent, employer, or joint venture partner for any user
While we verify service providers and maintain quality standards, verification does not constitute a guarantee of performance, expertise, or suitability for any particular project.
3. Limitation of Liability
To the maximum extent permitted by applicable law, CNXION shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use or inability to use the platform or its features
- Any conduct, content, or services provided by other users
- Any transactions, disputes, or disagreements between clients and service providers
- The quality, accuracy, or completeness of any deliverables or work product
- Unauthorized access to your account, communications, or data
- Service interruptions, technical failures, or security breaches
- Any errors, omissions, or inaccuracies in platform content or user profiles
- Delays, cancellations, or failures to deliver on project commitments
In no event shall CNXION's total liability exceed the amount of fees paid by you to the platform in the twelve (12) months preceding the claim.
4. User Responsibility
You acknowledge that you use the platform at your own risk. You are solely responsible for:
- Verifying the qualifications, experience, and suitability of service providers before engagement
- Conducting appropriate due diligence on all parties and projects
- Clearly defining project requirements, deliverables, timelines, and acceptance criteria
- Your interactions, communications, and agreements with other users
- Ensuring deliverables meet your specific technical and business requirements
- Complying with all applicable laws, regulations, and industry standards
- Protecting your intellectual property and confidential information
5. Technical Work Disclaimer
Given the specialized nature of AI and blockchain services facilitated through our platform:
- CNXION makes no representations about the functionality, security, or compliance of code, smart contracts, or AI models developed by service providers
- Clients are responsible for independently auditing and testing all technical deliverables
- We do not guarantee that smart contract audits, security reviews, or code assessments will identify all vulnerabilities
- Results and performance claims (such as efficiency gains or cost reductions) are based on reported user outcomes and are not guaranteed
6. Third-Party Content and Services
Our platform may contain links to third-party websites, services, or integrations. CNXION:
- Does not control or endorse any third-party content or services
- Is not responsible for the availability, accuracy, or practices of external sites
- Is not liable for any damages arising from your use of third-party services
Use of third-party services, including payment processors and communication tools, is at your own risk and subject to their respective terms and policies.
7. Transaction Disclaimers
All transactions on CNXION are between Clients and Service Providers directly. While we provide payment protection features:
- We do not guarantee the satisfactory completion of any project
- Disputes between users must be resolved through our dispute resolution process or appropriate legal channels
- We reserve the right to make final decisions on disputes at our discretion
- Refunds and payment releases are subject to our terms of service and dispute outcomes
8. Indemnification
You agree to indemnify, defend, and hold harmless CNXION and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the platform or violation of these terms
- Your interactions or transactions with other users
- Any content you submit or services you provide through the platform
- Your violation of any third-party rights or applicable laws
9. Governing Law
This disclaimer and your use of the platform shall be governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these terms shall be resolved through the dispute resolution mechanisms outlined in our Terms and Conditions.
